1SourceAutoWarranty Claims Status, Liquidation, State of Hawaii Insurance Division Info

Tips for buying a new or used car extended warranty, avoiding scams.

1SourceAutoWarranty Claims Status

As you probably know by now if you've bought an extended warranty for your car a few years ago from 1SourceAutowarranty, they have gone out of business, after the State Of Hawaii Insurance Division took over 1Source Auto Warranty and ordered them liquidated. But where does that leave you, the contract holder of a 1 Source Auto Warranty now that they are out of business? What are your options and rights? We have set up this information page to give you the most up to date status of the 1SourceAutoWarranty and PrimeGuard insurance liquidation. Because of limited amounts of funds available in seized bank accounts, Hawaii set a cutoff date of 11/30/2006 to file claims. After that no other claims are accepted and you are unfortunately out of luck.

Status On 1SourceAutoWarranty Claims As Of 2/14/2008:

Liquidator has petitioned the court to approve cash disbursements

A tentative settlement agreement was reached between the Liquidator of PrimeGuard, and all other entities involved.  Liquidator’s Petition for Final Order and Judgment Approving Liquidator’s Settlement has been submitted to the bankruptcy court. The Liquidator’s Petition will be heard on March 5, 2008. Keep in mind there is only a few hundred thousand dollars in frozen assets, and nearly $300,000 in legal bills.  It is unlikely that anyone who is owed money would get much of anything at all.

History of the failure of 1SourceAutowarranty

On December 19, 2005, the Court of the State of Hawaii issued an Order of Liquidation of PrimeGuard Insurance Co., the insurer who backed 1SourceAutoWarranty. The Order restrained PrimeGuard from insuring any warranties issued by First Assured, 1Source or any other warranty company. First Assured and 1Source were shut down as a result. We recommend you visit this page often to stay up to date with developments, and especially you must check the State Of Hawaii link below every 2 weeks. You must file a separate claim with both the Federal bankruptcy court in Colorado and the State liquidation court in Hawaii by any applicable deadlines, in order to have it considered by each court. Thus far, only the State liquidation court in Hawaii has established a deadline to file claims.

If you are a Florida 1SourceAutoWarranty customer:
If you live in Florida and bought a warranty from 1SourceAutoWarranty, you may still be able to get your auto warranty claims fulfilled, because contracts sold to Florida residents are managed by a different Florida registered warranty administrator, as 1Source could not sell directly in Florida, and there should be a guaranty bond in place. Florida has the strictest requirements on Extended Warranties of any state.

Claims no longer accepted by 1SourceAutoWarranty:
The First Circuit Court of the State of Hawaii approved the official claims filing procedures and forms.
IMPORTANT: November 30, 2006 was the deadline for filing your One Source Auto Warranty claims with the Liquidator.

There probably are funds in the PrimeGuard bank account, the question is how much. Once Hawaii collects all vehicle warranty claims and verifies how much is in the account, they can begin to disperse whatever funds are there, with no guarantees of which auto warranty customer will get paid. I suggest you collect all your support documentation now, like service invoices indicating paid status. You need proof that you paid, so a receipt or credit card statement is needed. We don't know how long it will be until the liquidator is ready to take your claim or if it will be processed at all.
